- HGB inside a PT PMA: a foreign-owned Indonesian company that can hold Hak Guna Bangunan or Hak Pakai in its own name, a right that can also arise the moment a seller's Hak Milik parcel converts at settlement.

Why The Nominee Shortcut Fails
Some agents still float a workaround where an Indonesian citizen holds the Hak Milik title on paper while a foreigner runs the property behind it. Courts do not read that as clever structuring; they read it as a sham, and two instruments back that reading up:
- Under SEMA Nomor 10 Tahun 2020, Indonesia's Supreme Court tells judges to declare a nominee agreement void outright whenever it fails the lawful-cause requirement set out in Article 1320 of the Civil Code.
- Peraturan Daerah Provinsi Bali Nomor 4 Tahun 2026 goes a step further at province level, ruling out any land transfer dressed up as a nominee scheme and attaching fines, permit cancellation and forced demolition to a breach.
A nominee arrangement is not a grey area on this cliff. It is a structure the courts and the province have both moved to unwind.
